Debt Collection

Massachusetts (MA) works in accordance with the federal laws in dealing with collection agencies and or law firms that collect debts.  These laws are known as the Fair Debt Collection Practices Act (FDCPA)

In addition in Massachusetts

  1. The original debt collector may contact a third party about the debt for a limited number of times.
  2. The debt collector and the original debt collector is not allowed to:
  3. Call more then twice in one week to the home or to call more than two times in a month to places other than their home.
  4. not permitted to call unauthorized third parties about the debts
  5. permitted to make only one visit without consent  over a 30 day period
  6. not permitted to make any office visits without consent
  7. not permitted to suggest that they are a lawyer or allowed to give legal advice
  8. Creditor must send a written notice within 30 days of their first communication with their debtor

THE CREDITOR HAS THE RIGHT TO MAKE A WRITTEN OR ORAL REQUEST THAT TELEPHONE CALLS REGARDING THE CREDITORS  DEBT NOT BE MADE TO THEM AT THEIR PLACE OF EMPLOYMENT. ANY SUCH ORAL REQUEST WILL BE VALID FOR ONLY TEN DAYS UNLESS YOU PROVIDE WRITTEN CONFIRMATION OF THE REQUEST POSTMARKED OR DELIVERED WITHIN SEVEN DAYS OF SUCH REQUEST. YOU MAY TERMINATE THIS REQUEST BY WRITING TO THE CREDITOR.

The maximum Interest Rate a Collection Agency Can Charge in Massachusetts is 6%

Massachusetts Wage Protection is $125 per week or 75% protected by federal laws.

The Statute of limitations is the amount of time by law for a set period of time after a certain event, that legal proceedings can happen based on that event can be initiated.  With debt, the statues of limitation apply to the time period after you have become past due on your payments.  In other words.  You are not considered delinquent based on your last payment, but rather the day that you went past due.
